NOTICE OF PUBLIC HEARINGS
PROPOSED AMENDMENTS
CODE OF ORDINANCES  

The Belfast City Council shall conduct a public hearing on Tuesday, September 11, 2007, beginning at 7:00 p.m. or as soon as practical thereafter, in the cafeteria of the Troy Howard Middle School, which is located on Lincolnville Avenue, regarding proposed amendments to the Belfast Code of Ordinances, Chapter 66, General Provisions and Chapter 102, Zoning.  The hearing constitutes the Council’s First Reading of the Ordinance amendments outlined below, all of which are associated with the Council proposal to allow a larger retail development in the Route 3 area.   

1.   Chapter 66, General Provisions.  Amendments to several definitions.

2.   Chapter 102, Zoning.  Amendments to Article IV, Description of Districts, regarding existing boundaries for the Route 3 Commercial zone, the Office Park zone and the Residential Agricultural II zone.  It is specifically noted that the boundary changes would result in some properties changing from a commercial zoning district to a more restrictive district.   

3.   Chapter 102, Zoning.  Amendments to Article V, District Regulations, to allow retail development greater than 75,000 square feet in size in that section of the Route 3 Commercial zone that is located northerly of Rt 3 and the Rt One by-pass to the east and Crocker Road to the west.  Amendments also would eliminate retail, restaurant, and service stations as permitted uses in the section of the Route  3 zone located westerly of Crocker Road. 

4.   Chapter 102, Zoning.  Amendments to Article V, District Regulations, for the Office Park zone.  Amendments largely affect amount of area included in the Office Park zone and prohibiting the establishment of a retail use in the section of this zone located westerly of Crocker Road.

5.   Chapter 102, Zoning.  Amendments to Article X, Contract Rezoning, to allow the use of contract rezoning to regulate retail uses greater than 75,000 square feet in the Route 3 Commercial zone. 

The public, particularly persons who own property in the area, are encouraged to attend the public hearing and to express their comments to the Council.  Comment also may be submitted in writing or by email.  Written comment must be received by 5:00 p.m. on September 11th by writing: Roberta Fogg, City Clerk, City of Belfast, 131 Church Street, Belfast, ME, 04915.  Email comment must be received by 5:00 p.m. on September 11th at the following email address: cityclerk@cityofbelfast.org
