5)      Public Hearings: 

         The City Council, at its meeting of Tuesday, January 29, 2008, beginning at 7:00 p.m. or as soon as practical thereafter, in the Council Chambers of Belfast City Hall, shall conduct public hearings regarding amendments to the City Code of Ordinances, Chapter 102, Zoning, regarding the regulation of uses in the Route 3 Commercial zoning district, particularly the so-called ‘Les Hills’ property owned by Bank of America.  The public is invited to attend the hearings and to express their comments to the Council. 

         The hearings involve two differing approaches, including: 

         Approach #1 requires that any use of the ‘Les Hills’ property be subject to review pursuant to the City contract rezoning process and that an applicant be required to prepare a master plan that identifies how all use of the property would occur.  This proposal also would require contract rezoning for any proposed use of the 1.3 acre property located at the corner of Route 3 and Crocker Road, the former H&A auto sales and auto body business, which is now owned by Bank of America. 

         Approach # 2 involves the City adopting specific nonresidential performance standards to better manage any use of the ‘Les Hills’ property.  These standards focus on establishing more specific landscaping/screening and buffering requirements that would apply to this property.     

         Wayne Marshall, City Planner, will provide a brief explanation of the above approaches and following proposals prior to conducting the respective hearings.   

         Approach # 1 – Contract Rezoning.   Requires amendments to the sections of the City Code of Ordinances, Chapter 102, Zoning, identified in 5. 1 and 5.2 below.  The amendments identified in 5.3 are also associated with this approach. 

5.1      Amendments to Chapter 102, Zoning, Article V, District Regulations, Division 24, Route 3 Commercial District.  Amendments identify how contract rezoning and preparation of a master plan would apply to the ‘Les Hills’ property, reference Map 5, Lots 11, 19, 19A, 21, 23, and 36A, and how contract rezoning would apply to property identified as Map 5, Lot 33. 

5.2      Amendments to Chapter 102, Zoning, Article X, Contract Rezoning, Division 2, Office Park, Route 3 Commercial and Searsport Avenue Commercial District.  Amendments identify both the requirement and process to consider contract rezoning and preparation of a master plan for any use of the ‘Les Hills’ property, reference Map 5, Lots 11, 19, 19A, 21, 23 and 36A, and how contract rezoning would apply to property identified as Map 5, Lot 33. 

5.3      Amendments to Chapter 102, Zoning, Article IX, Nonresidential Performance Standards, Division 3, Nonresidential Development Standards for the Route 3 Commercial District.  Amendments identify minor revisions to the standards to address such issues as requiring the Board to consider pedestrian and bicycle issues in its review of an application.  

Approach # 2.  Specific Nonresidential Performance Standards for Les Hills property.  Requires amendments to the sections of the City Code of Ordinances, Chapter 102, Zoning, identified in 5. 4 and 5.5 below.   

5.4      Amendments to Chapter 102, Zoning, Article V, District Regulations, Division 24, Route 3 Commercial District.  Amendments identify that specific nonresidential performance standards apply to any development on the ‘Les Hills’ property, reference Map 5, Lots 11, 19, 19A, 21, 23, and 36A. 

5.5      Amendments to Chapter 102, Zoning, Article IX, Nonresidential Performance Standards, Division 3, Nonresidential Development Standards for the Route 3 Commercial District.  Amendments identify the specific nonresidential performance standards that would apply to any development of the Les Hills property,  reference Map 5, Lots 11, 19, 19A, 21, 23, and 36A. 

6)      Council Second Reading and action regarding Ordinance amendments on which public hearings were conducted; reference amendments 5.1, 5.2, 5.3, 5.4 and 5.5.  

7)      Council discussion and consideration of adoption of a policy statement regarding retail development in the Route 3 Commercial zoning district.
